Herbert Governor of Utah State Capitol Salt Lake City, Utah Dear Governor Herbert: Over the past several months, the Department of Homeland Security (DHS) has participated in vigorous discussions with governors' offices, state legislatures, state motor vehicle administrators, and national associations with the common goal of working together to strengthen the security of state-issued driver's licenses and non-driver identification cards (hereafter "driver's licenses"). Under current law, the highest executive overseeing the department of motor vehicles is charged with demonstrating that your state will be in compliance with REAL ID by December 31, This letter is to provide clarification of upcoming timelines and statutory deadlines under REAL ID, the Department's responsibility for enforcing REAL ID, and the path forward proposed in S. 1261, the PASS ID Act. Under REAL ID, states not able to certify full compliance by December 31, 2009, may request an extension until May 10, A Material Compliance Checklist must accompany the extension request. As of December 31, 2009, DHS and its Components may not accept driver's licenses issued by states that are not in material compliance with REAL ID Act for any official purpose, including identification for domestic air travel. I am well aware of the burdens presented by this deadline and the statutory prohibitions that will limit participation in 13 states. It is my firm belief that a secure identification system must facilitate the participation by all states, but I am also committed to ensuring baseline security standards for state-issued driver's licenses, which cannot be delayed through endless extensions. The PASS ID Act represents the best path forward to achieving this important security initiative and fulfilling a key 9/11 Commission recommendation. Until such time as Congress acts on the PASS ID Act, the Department remains obligated to enforce the provisions of the REAL ID Act. However, to allow Congress to complete its work, I am extending the deadline for states to submit requests for extensions and the required Material Compliance Checklist until December 1, DHS will issue a final rule to effect this change in deadline. w w w.d h s.gov

So her question to us is, if this is the case, why can't the U.S. Military ID be used as proof of legal/lawful presence? I copied this from the FAQ's on AAMVA's website: Topic/Section: Application and Documents the Applicant Must Provide Question: Please explain why military ID cards are not included on the acceptable documents list. Are there plans to expand the list, primarily for people born in the U.S.? Response: While military ID cards do provide evidence of identity, they do not provide evidence of lawful status and would require special

4 procedures to verify the lawful presence of their bearers. However, acceptance of certain military documents may be considered at some point in the future. Can you expand on "would require special procedures to verify lawful presence? And can you please let us know if there are other reasons? First of all we would like to congratulate you and the State of Utah for your efforts in supporting our shared goal of improving the security of state-issued driver licenses and identification cards. While the information provided demonstrates that your state has made substantial progress in meeting the security standards of the Act, DHS does not have sufficient information to determine if the State of Utah is meeting all of the provisions of the regulation. We request that you provide DHS with additional information of how and when your state will implement the requirements described in the enclosed list. To receive a Final Determination that your state meets the Act's requirements, the State of Utah should submit to DHS, within 30 calendar days of the receipt of this letter, certification documents allowing DHS to determine whether the State of Utah meets the security standards of the Act or has a comparable program that meets those standards. DHS is granting deferments for states that it is unable to determine as meeting the Act's requirements by January 15, Under this deferment, Federal agencies may continue to accept for official purposes including boarding aircraft driver's licenses and identity cards issued by all states. DHS will undertake, in consultation with States and stakeholders, to develop a schedule for the phased enforcement of the Act's statutory prohibitions to ensure that states are treated in a fair and proportional manner. DHS expects to publish a schedule by early fall 2013 and begin implementation at a suitable date thereafter. States that continue to provide information and show progress will be in the best position for DHS to be able to continue to grant deferments. DHS is committed to working with the State of Utah in meeting the security standards for driver's licenses and identification cards to ensure that Federal agencies may continue to accept them for official purposes. The division has met fifteen of the eighteen material compliance requirements and thirteen of the twenty-one full compliance requirements (see attached). In addition, by January 1, 2013, the division will meet three more requirements (one material and two full). The division plans to connect to the electronic verification systems as they become available. Utah Code Annotated states the division may not implement the provisions of the REAL ID Act. However, the division has been allowed to comply with the majority of the provisions which have been adopted by Utah administrative rule or authorized under Utah Code. At this time, I feel Utah has made great strides to improve the integrity and security of the data collected and the certificates issued. 40 37.13(b)(3) Verify birth certificates At the present time, all identity and legal/lawful presence documents are reviewed by examiners trained in fraudulent document recognition. The documents are scanned to the applicant's record in Utah's Driver License System database. Specific data fields from the certificate (first and last name, date of birth, state of birth, state file number, state filed date) are entered in the DL System and are retained for the electronic verification process. When the EVVE system is fully operational, Utah anticipates verifying U.S. birth certificates electronically through EVVE at the time of application. All records that have been entered prior to the "real-time" electronic verification will be sent through a batch process. In the event of a discrepancy, the applicant will be sent a letter informing them of the problem. If the issue is not resolved, the driver's license or ID card will be withdrawn (b)(4) Verify U. S. Passports and U.S. Visa with accompanying valid 1-94 At the present time, all identity and legal/lawful presence documents are reviewed by examiners trained in fraudulent document recognition. In the event of a discrepancy, the applicant will be sent a letter informing them of the problem. If the issue is not resolved, the driver's license or ID card will be withdrawn. Utah does verify U.S. Visa with accompanying valid 1-94 through SAVE. These documents along with the SAVE verification are scanned to the applicant's record (b)(5) Verify REAL ID driver's licenses and identification cards with the State of issuance. At the present time, all identity and legal/lawful presence documents are reviewed by examiners trained in fraudulent document recognition. Utah does use the existing CDLIS and PDPS electronic verifications to verify driver license and ID cards at the time of application. If there is any discrepancy, it must be resolved before the driver's license or ID card is issued. In the future, Utah anticipates verifying REAL ID driver's licenses and identification cards with the state of issuance when the national system is available and fully operational (d) Conduct a review and submit a report to DHS on card design and ability of the card to resist forgery and counterfeiting.
