J reunión Comité de Candidaturas TeHepajibHaH KOH^epeHUHH ÜBanuaTb BTopaa cecciih, KoMHTeT no KaHniuiaTypaM 22 C/NOM/11 27 October 1983 Original: English Item 58.9 of the provisional agenda ELECTION OF FOUR MEMBERS OF THE CONCILIATION AND GOOD OFFICES COMMISSION RESPONSIBLE FOR SEEKING THE SETTLEMENT OF ANY DISPUTES WHICH MAY ARISE BETWEEN STATES PARTIES TO THE CONVENTION AGAINST DISCRIMINATION IN EDUCATION SUMMARY In accordance with Article 3, paragraph 2, of the Protocol instituting the above Commission, the Executive Board transmits to the General Conference a list in alphabetical order of the persons nominated by the States Parties to the said Protocol for the purpose of filling the vacant seats on the Commission. This list is contained in Annex II to this document. Annex III reproduces curricula vitae provided by the States Parties for the persons nominated. The list of States Parties to the Protocol as at 18 October 1983 is given in Annex IV. Decision requested: paragraphs 13 and At its twelfth session on 10 December 1962, the General Conference adopted a Protocol instituting a Conciliation and Good Offices Commission to be responsible for seeking the settlement of any disputes which may arise between States Parties to the Convention against Discrimination in Education. 2. Article 1 of this Protocol established, under the auspices of Unesco, a Conciliation and Good Offices Commission, to be responsible for seeking the amicable settlement of disputes, between States Parties to the Convention, concerning the application or interpretation of the Convention. 3. The Protocol having entered into force on 24 October 1968, the General Conference at its sixteenth session, under Article 2 of the Protocol, elected the eleven members of the Commission on 6 November A list of members of the Commission, with indication of the dates of their election or reelection, appears in Annex I. 5. Under Article 2 of the Protocol, the members of the Commission must be persons of high moral standing and acknowledged impartiality. They serve in their personal capacity. In the election of members of the Commission, the General Conference shall endeavour to include persons of recognized competence in the field of education and persons having judicial experience, or legal experience, particularly of an international character. It shall also give consideration to equitable geographical distribution of membership and to the representation of the different forms of civilization as well as of the principal legal systems. 6. Article 4, paragraph 1, of the Protocol provides that the Commission may not include more, than one national of the same state. 2 0ÜÜT.Í983.

Article 3, paragraph 1, of the Protocol provides that the members of the Commission shall be elected from a list of persons nominated for the purpose by the States Parties to the Protocol, after consultation with their National Commissions for Unesco. Each State Party may nominate not more than four persons, who must be nationals of States Parties to the Protocol. 8. In pursuance of paragraph 2 of the same Article, the Director-General invited the States Parties to the Protocol to submit nominations, and he communicated to the Executive Board the names "of the persons thus nominated, listed in alphabetical order. 9. Having considered this item of the agenda, the Executive Board at its 117th session adopted the following decision: 'The Executive Board, 1. Recalling the provisions of Article 3 of the Protocol instituting a Conciliation and Good Offices Commission to be responsible for seeking the settlement of any disputes which may arise between States Parties to the Convention against Discrimination in Education, 2. Having studied the list of persons nominated by the States.Parties to the aforementioned Protocol for the purpose of the election of four members of the Commission, which the Director-General has submitted to it in accordance with Article 3, paragraph 2, of the said Protocol (document 117 EX/16), 3. Transmits this list to the General Conference'. 10. The list of persons nominated is reproduced in Annex II of the present document. 11. Annex III contains curricula vitae provided by the States Parties to the Protocol for the persons nominated by them. 12. The list of States Parties to the Protocol as at 18,October 1983 is reproduced in Annex IV. 13. The term of office of the following three members of the Commission having expired, the General Conference at its twenty-second session will be required to fill the corresponding three vacant seats: Dr Ismael Antonio Vargas Bonilla (Costa Rica) Dr Vincent Austin Depascuale (Malta) Mr Halim Ibrahim Grais (Egypt) 14. A fourth seat has fallen vacant following the death of Professor Dr Joseph A. Lauwerys (United Kingdom) and the General Conference will be required to fill this vacant seat also. Article 5 of the Protocol provides that members of the Commission shall be eligible for re-election if renominated.
