23 By using the YYP Brazilian LGBTT organisation ABGLT talks to government officials of all departments to take up the issues that LGBT people face in their respective areas. Before the Principles they would have addressed less tasks and with less convincing arguments. The fact that there is a document putting all important issues together, linked with human rights makes it every important. YOGYAKARTA PRINCIPLES Good practices: Brazil, ABGLT Since 2004 Brazilian government has set up a federal campaign to end homophobia. That is really needed: many homosexual and trans and gender variant people still die a violent death. This year of the 265 registered murders on trans people, 126 took place in Brazil. The murders of gay men are not counted in this number.
24 Good practices: Transgender Network Netherlands (TNN) Since 2008 Transgender Network Netherlands has been in touch with the senior policy officer of the Justice Dept. of national government. They tell told him about the YYP, what they are, what they are for, and that Dutch government had already said to endorse them. In the communication with several governments and several department they focused on principles 3 and 18, Recognition before the law as a person, in all circumstances, and 18: Freedom from medical maltreatment. In the course of the debate we even threatened to bring the Netherlands before the CAT commission. The effect has been a clear understanding of Dutch government that the requirement of sterilization and genital surgery to adapt the person as much as possible to the other (recognized gender is against human rights. There is a tendency that newcomers are far more progressive than the old ones that change legislation.. The latter have a
25 Good practices: ILGA,OII Intersex Another, sex related issue that the Yogyakarta Principles have a say in, is intersex and the right to be free from torture. These days intersex is also known as Disorders of Sex Development, but that is a recent pathologizing term. In a way intersex does not belong with LGBT, but on the other hand it is being covered in the YYP as an issue that needs human rights attention. Also there are quite some parallels and the mechanisms of oppression are all sex, gender and sexuality based. The issue for intersex people (not people with an intersex condition; maybe people with a sex variation) is a total lack of autonomy and of recognition before the law. In issues that contribute to grave bodily harm such as infant genital mutilation in order to spare the child for wonder or mild psychological distress it is being mutilated, subjected to cruel and unusual treatment because doctors and other gatekeepers of how people s sex should look and work.
