1 NS/RKT/0212/079 PREAH REACH KRET On Establishment of National Committee on Coastal Area Management and Development We, Preah Bat Norodom Sihamoni King of the Kingdom of Cambodia - Having seen the Constitution of the Kingdom of Cambodia; - Having seen Preah Reach Kret N o NS/RKT/ 0908/1055 of September 25, 2008 on the Appointment of the Royal Government of Cambodia; - Having seen Preah Reach Kram N o 02/NS/94 of July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers; - Having seen Preah Reach Kram N o NS/RKM/1296/36 of December 24, 1996 promulgating the Law on Environmental Protection and Natural Resource Management; - Having seen Preah Reach Kram N o NS/RKM/0701/09 of July 13, 2001 promulgating the Law on Mineral Resources Management and Exploitation; - Having seen Preah Reach Kram N o NS/RKM/08001/14 of August 30, 2001 promulgating the Land Law - Having seen Preah Reach Kram N o NS/RKM/0609/007 dated June 10, 2009 promulgating Law on Tourism - Having seen the proposal of Samdech Akak Moha Sena Padei Techo Hun Sen, Prime Minister of Kingdom of Cambodia upon the approval by Council of Ministers in the plenary meeting on 13, January 2012 HEREBY DECIDED Chapter 1 General Provisions Article 1. Establish the National Committee on Coastal Area Management and Development, which is abbreviated as NCCMD, shall be the direct subordinates of Royal Government in charge of managing and developing coastal areas of Kingdom of Cambodia in the sustainable and responsible manner. 1 P a g e

2 Chapter 2 Structure Article 2. NCCMD shall be composed of the following: - Prime Minister of Kingdom of Cambodia Honorable President - Minister of Ministry of Land Management, President Urban Planning and Construction - Minister of Ministry of Environment Vice President - Minister of Ministry of Tourism Permanent Vice President - Secretary of State of the Council of Ministers 01, Member - Secretary of State of Ministry of Interior 01, Member - Secretary of State of Ministry of National Defense 01, Member - Secretary of State of Ministry of Economy and Finance 01, Member - Secretary of State of Ministry of Agriculture, Forestry and Fisheries 01, Member - Secretary of State of Ministry of Industry, Mines and Energy 01, Member - Secretary of State of Ministry of Water Resources and Meteorology 01, Member - Secretary of State of Ministry of Public Works and Transport 01, Member - Secretary of State of Ministry of Planning 01, Member - Secretary of State of Ministry of Health 01, Member - General Secretary of Council For The Development Member Of Cambodia (CDC) - Commander in Chief of National Police commissioner Member - Commander in Chief of Royal Cambodian Armed Forces Member - President of Board of Governors in 4 coastal areas Member - Representative of National Committee of Marine Security 01, Member - Representative of National Authority for Land Dispute Resolution 01, Member - Representative of General Department of Techniques 01, Member of Ministry of Environment - Representative of General Department of Land Management and Urban Planning of Ministry Land Management, Urban Planning and Construction 01, Member - Secretary-General of NCCMD Member The precise composition of NCCMD shall be determined by the Decision of the Royal Government. Article 3. NCCMD shall obtain the responsibilities in implementing their tasks on the coastal areas, reserved land of coastal areas, subordinate areas, islands, firth, river, canal, water line 2 P a g e

3 connected to the sea and surface water next to coastal areas of Kingdom of Cambodia in the aspect of urbanization, environment and tourism. Article 4. Shall be established the General Secretariat, located in the Ministry of Tourism, subordinated for NCCMD to perform daily tasks. Chapter 3 Functions and Duties of NCCMD Article 5. NCCMD has functions and duties as the following: - Organize the policy, action plan, master plan, activities plan, program, and other projects which are related to the management and development of coastal areas - Organize legal frameworks and necessary policies to assure the management, conservation, and development in the coastal areas with the manner of transparency, equity, and environmental sustainability - Examine, prevent, and take necessary actions to prevent any inactivity which may harm to environment and natural resources along the coastal areas - Examine and evaluate any development projects and project s implementation in coastal areas aligning with the guideline of the Royal Government for coastal areas development - Take part in examining and providing the comments to appropriate institution on the investment s proposals regarding the coastal areas, reserved land of coastal areas, subordinate areas, islands, firth, river, canal, water line connected to the sea and water surface next to the coast - Examine, monitor, and facilitate any on-going and future-plan activities of ministries, institutions, sub-national administration, national and international organizations, non-governmental organizations, any civil societies and private sectors located along the coastal areas in order to speed up the works effectively and sustainably - Mainstream the knowledge to sub-national administration, private sector, and any relevant parties to comprehend the development of coastal areas - Cooperate with the most beautiful bay in the world club and relevant international institutions in order to promote the development of coastal areas - Educate, train the human resources to response to the necessities in managing and developing the coastal areas - Cooperate with the ministries, national institutions, private sectors, and any relevant parties to facilitate the above works effectively - Prepare the annual budget for NCCMD - Write the semi-annual and annual reports for the Royal Government 3 P a g e

4 - Perform other duties assigned by the Royal Government of Cambodia Chapter 4 The Functioning of NCCMD Article 6. NCCMD shall have at least 2 meetings a year upon the invitation of the President. In the necessary case, NCCMD s President may invite the representatives of Ministries, Institutions, specialized officers, technicians or private sectors to participate in the meeting for consulting, discussing, and researching on any related issues with respect to their working frameworks. In case the president is absent, a Vice President, who is authorized by the president, may lead the meeting instead. Article 7. NCCMD possesses the right to request the intervention forces in order to implement its responsibilities if necessary. Article 8. NCCMD may obtain the technical consultants, national or international specialists according to the necessary. Article 9. General Secretariat of NCCMD shall be supervised by a Secretary General accompanied by a necessary number of Deputy Secretary Generals who are appointed by Royal Decree. The organization and functioning of General Secretariat of NCCMD shall be determined by Sub-Decree. Article 10. NCCMD possesses the rights to use the seal of Ministry of Land Management, Urban Planning and Construction in its working process. Article 11. The internal policy, form and working procedure of NCCMD shall be determined by the Decision of NCCMD. Chapter 5 Resources Article 12. NCCMD holds separated budget which is the appendix of the Ministry of Tourism s budgets. 4 P a g e

5 NCCMD possesses the right to receive and manage the funds which are come from aids of the developmental partners and international cooperation and from other sources for their working process. Chapter 6 Final Provision Article 13. All provisions contrary this Royal Decree shall be repealed. Article 14. Samdech Akak Moha Sena Padei Techo Hun Sen, Prime Minister of Kingdom of Cambodia shall implement this Sub-Decree upon the date of signature hereafter.
