3 1.0 Introduction The Canada-Northwest Territories Territorial Nominee Program Agreement (Nominee Program) is an accelerated process that provides eligible Foreign Nationals a pathway to becoming a permanent Canadian resident. There are two streams within the Northwest Territories Nominee Program: Employer Driven and Business Driven. The Department of Education, Culture and Employment is responsible for administering the Employer Driven streams of the Nominee Program. The Employer Driven Nominee Program streams support the recruitment and retention of Foreign Nationals when there are no qualified Canadians or permanent residents available. Employers submit application forms for Foreign Nationals they want to hire and nominate for permanent residency. Immigration is a shared responsibility between the Government of Canada and the Government of the Northwest Territories, whereas: The Government of Canada has sole responsibility for determining nationally, and for provinces and territories: who is admitted to Canada, immigration classes, and annual immigration levels. The Government of the Northwest Territories and the Government of Canada s Citizenship and Immigration Canada entered into the first Canada-Northwest Territories Territorial Nominee Program Agreement in It was renewed in 2013, for five additional years. The Agreement allows the Government of the Northwest Territories to nominate Foreign Nationals for permanent residency in the Northwest Territories. These Application Form Guidelines are for the Employer Driven streams only and outline information and eligibility criteria required for Employers to apply under the Nominee Program s Employer Driven streams. Employers need to complete and submit one of the application forms to nominate Foreign National employees for permanent residency in Canada. The Department of Industry, Tourism and Investment is responsible for administering the Business Driven streams of the Nominee Program. Information on how to apply to the Business Driven streams is located at or As determined by Citizenship and Immigration Canada, Refugee Claimants are not eligible for the Nominee Program. 4 2.0 Service Standards The Department of Education, Culture and Employment s Nominee Program Staff will: provide quality and professional service; respond to inquiries within three (3) business days; assess all complete application packages (including all necessary forms and certified documentation) within ten (10) weeks of receipt (new as of March 12, 2016); assess all applications by date received to maintain fairness and consistency (new as of March 12, 2016); and provide follow-up with Employers, as appropriate, to facilitate processing of application forms. 5 3.0 Purpose of the Nominee Program The purpose of the Nominee Program is to fill identified labour shortages and business investment needs in the Northwest Territories through employment and immigration of Foreign Nationals to Canada. 3.1 Program Objectives The Nominee Program is designed to support the immigration of Foreign Nationals who contribute to the economic development and success of the Northwest Territories and who express interest in immigrating to Canada. The Nominee Program has the following four core objectives: support territorial Employers to fill labour shortages when there are no qualified Canadians available; encourage direct investment in the economy and businesses of the Northwest Territories; strengthen the Northwest Territories ability to enhance the economic benefits of immigration to the territory; and nominate eligible Foreign Nationals for permanent residency in Canada. 6 4.0 Nominee Program Streams The Nominee Program delivered by the Government of the Northwest Territories Departments of Education, Culture and Employment and Industry, Tourism and Investment has two distinct program streams: Employer Driven Streams The Employer Driven streams of the Nominee Program support Employers to recruit and retain Foreign Nationals who possess the skills and experience required by the Employer and who meet program eligibility criteria, when there are no qualified Canadians or permanent residents available. Employer Driven Streams are: 1. Critical Impact Workers 2. Skilled Workers 3. Express Entry System for Skilled Workers (New 2015) Please note: this Application Form Guideline covers the Employer Driven streams only. Business Driven Streams Business Driven streams assist Foreign Nationals with the ability to establish, purchase, or invest in an existing business, selected primarily on the basis of its ability to create jobs for the Foreign National and other Canadians. Business Driven Streams are: 1. Self-employed. 2. Entrepreneur. Please visit or for information on applying to the Business Driven streams. 4.1 Application Form Process Before applying under one of the Employer Driven streams, please review these guidelines for information on the application form process for each Nominee Program delivered by Education, Culture and Employment; namely Critical Impact Worker, Skilled Worker, or the new Express Entry System. 7 4.2 How to Submit an Application Form You can submit your application forms in two ways; by mail or in person. Application forms will not be accepted by fax or because original documents are required for verification purposes. Box 1320 Yellowknife, Northwest Territories X1A 2L9 Employers can contact the Coordinator, Immigration by phone or at: Toll Free Number: immigration@gov.nt.ca 4.3 Application Form Assessment Process Pre-screening All application forms received will be acknowledged by an receipt to the address provided by the Employer. The Employer is responsible for providing (and updating) an accurate and current address on the application forms. Pre-screening of all application forms is conducted to check that the application forms are complete. To ensure your application form(s) contains all required documents and information, please use the checklist form provided on the website that applies to the Nominee Program stream you wish to access; namely Critical Impact Worker, Skilled Worker, or the new Express Entry System. Incomplete Application Form Process If an application form is incomplete it will not be assessed because all required documents and information are necessary to determine eligibility for the Nominee Program. 8 When an incomplete application form is received an will be sent to the Employer that provides 45 calendar days in which to submit the outstanding documentation and/or information. The 45 calendar day deadline begins on the day the Nominee Program office received the incomplete application form. If after 45 calendar days the documentation and/or information have not been received, the application form will be returned to the Employer and the Employer s file will be closed. After 45 days, the Employer must submit a new application form to begin the Nominee Program application form process again. Complete Application Form Process When an application form is complete, an will be sent to the Employer indicating that a complete application form has been received and will be assessed. The application form will be assessed through a review and verification of all documentation and/or information based on eligibility criteria as described in Section 8.0 Criteria for Employer Driven Streams. Once the assessment is completed, a decision will be made as to whether or not the application form is eligible for nomination to the Government of Canada. The Employer and the Nominee (Foreign National) will receive letters by communicating the decision; as described in section 5.0 Application Form Approval and Nomination Process. The entire application form process will normally take up to ten (10) weeks from the date a complete application form was received by the Department of Education, Culture and Employment (new as of March 12,2016). 9 5.0 Application Form Approval and Nomination Process When an application form is approved, a formal letter will be sent to the Employer and/or Immigration Representative (an individual who an Employer and/or nominee appointed to conduct business on their behalf with the Nominee Program), and the Nominee (Foreign National) by that indicates the application form has been approved. The approval letter will outline the responsibility of the Employer and the Nominee to sign a Memorandum of Understanding for the respective stream. The Nominee is given instructions to submit their application for permanent residency to Citizenship and Immigration Canada within the validation period for nomination. The validation period is one (1) year from the date of the formal letter that approves the application form. Nominations are valid for one year only. The Nominee Program in the Northwest Territories will not grant nomination extensions. Employer Driven Nominee Program Application Form Guidelines Page 8 of 23

10 6.0 Application Denial When an application form is denied a letter will be sent to the Employer and/or Immigration Representative and the Foreign National by notifying them that the application form has been denied and the reasons for the denial. Reasons an application form will be denied include: the applicant does not meet the program criteria; the applicant did not submit the required documentation and/or information within the 45 calendar day limit; the Foreign National no longer resides and/or works in the Northwest Territories when a decision was made; application form is incomplete, inadequate, outdated and/or expired; it has been determined there are grounds that there has been misrepresentation in the application form; and other reasons for denying an application form will be referenced in the denial letter. 11 7.0 Secondary Review for Application Forms Denied An Employer and/or Immigration Representative may request a second review after an application form has been denied. A request for a second review must be made, in writing, within 30 calendar days of the date on the denial letter. The letter must clearly state the Employer s reason(s) for a secondary review. A second review will be based on the documentation and/or information provided in the original application form package. The Assistant Deputy Minister, Labour and Income Security, Department of Education, Culture and Employment, is responsible for rendering a decision on second reviews. The Assistant Deputy Minister s decision on a secondary review is final and will be communicated to the Employer by . Please note the following: New supporting documentation and/or information will not be accepted as part of a second review. Request for a second review based on eligibility criteria will not be considered. To submit any new documents and/or information the Employer must reapply to the Nominee Program with a new application form package. 12 8.0 Criteria for Employer Driven Streams Each stream has specific criteria. Please read the criteria below and refer to the checklist form for the stream you are applying to when completing your application form. Application forms are located at: Employer Criteria Employer The Employer must be a registered business, industry association, or a local, municipal, First Nation or Territorial Government, in the Northwest Territories, that has been registered and operational for a minimum of six (6) months. Be in good standing with the Northwest Territories Workers Safety and Compensation Commission and the Northwest Territories Employment Standards office. Please Note: Foreign Nationals who own/operate a business within the Northwest Territories are not eligible to nominate themselves under the Employer Driven streams, but might be eligible under one of the Business Driven streams. Employment The term of employment must be for a permanent full-time position (minimum 30 hours per week). Please include an employment contract that is consistent with the Northwest Territories Employment Standards Act and that is not in conflict with existing collective bargaining agreements. Labour Market Impact Assessment Submit a copy of a positive Employment and Social Development Canada s Labour Market Impact Assessment, if applicable. A Labour Market Impact Assessment is a verification process whereby Employment and Social Development Canada assesses an offer of employment to ensure that the employment of a Foreign National will not have a negative impact on the Canadian labour market. Employers applying to nominate a Foreign National with an open work permit, or through the Northwest Territories Skilled Worker Stream or Express Entry System, do not need to submit a Labour Market Impact Assessment, but must follow and submit the job advertising requirements. 13 Job Advertising If an Employer is hiring a Foreign National, without a positive Labour Market Impact Assessment, then proof of local and national advertising and a summary of advertising results must be included with the application form. The summary of results must include a list of all application forms received in response to the advertised position and list reasons for refusal of employment. Do not submit the resumes you receive for the position posted. Minimum local and national recruitment efforts must have been placed within one (1) year prior to the submission of an application form. These are: advertise in a Northwest Territories newspaper where the job opportunity is available for a minimum of thirty (30) calendar days; and advertise on Government of Canada s Job Bank at for a minimum of thirty (30) calendar days. Wage Rate Provide a comparable industry rate of pay based on the businesses existing workforce rate-of-pay, rate-of-pay as advertised, and rate-of-pay in the Labour Market Impact Assessment, as applicable. Rate-of-pay must always be equal to or more than the current minimum wage of the Northwest Territories. Travel Costs An Employer who employs a Foreign National under the Critical Impact Worker stream, based on a positive Labour Market Impact Assessment, must adhere to the agreement and is obligated under the agreement to pay for the air travel costs for the Foreign National to come to the Northwest Territories from his/her place of permanent residence. If the Foreign National is not nominated or is not given permanent residence status, the Employer is also responsible to pay for the Foreign Nationals return airfare to his/her permanent place of residence, as per the Labour Market Impact Assessment agreement. Employers are not able to recover, directly or indirectly, any of the travel costs from a Foreign National. 8.2 Foreign Nationals General Criteria The following eligibility criteria apply to all Employer Driven streams unless stated otherwise: Foreign Nationals currently in Canada must have legal status to work and must have a valid work permit; and Employer Driven Nominee Program Application Form Guidelines Page 12 of 23

14 Foreign Nationals must satisfy the Nominee Program that they intend to settle permanently in the Northwest Territories. If a Foreign National is currently in Canada they must submit a valid work permit with the Employer s application form. Or, when a Foreign National arrives in the Northwest Territories they must provide a copy of the work permit or record of landing to the Nominee Program office (see section 11.0 Contact Information) within 15 calendar days of arriving. Occupational Certification A Foreign National must have the required certification or accreditation for the occupation based on Employer s requirements. If applicable, meet Northwest Territories certification, licensing, or registration requirements of the job. For nonregulated occupations, the Employer is responsible for ensuring that the nominee meets occupational standards and has the required work experience for the specific occupation. Approved Canadian Language Testing There are three language tests approved by the Government of Canada. A nominee must write one of the following three tests: The International English Language Testing System (IELTS) General Training; The Canadian English Language Proficiency Index Program (CELPIP-General); or, The Test d Évaluation de Français (to test proficiency in French). Other language tests or methods will not be accepted. Language tests are valid for two years from the date of the test results. The minimum language test standards set by Citizenship and Immigration Canada may change without notice. Please refer to the Government of Canada s website at for up-to-date information. Personal Documentation A Foreign National is required to submit the following documentation in original, or certified true copies (must be a clear, readable copy), translated into English or French: Foreign National s passport; Foreign National s birth certificate; Foreign National s marriage certificate; and birth certificate(s) and passport(s) for dependent(s). 15 Settlement Income A Foreign National must demonstrate they have sufficient funds to establish and maintain themselves and any dependents within the Northwest Territories Certified bank statements in the Foreign National s name or official letter issued by a bank need to accompany the application form and be translated into English or French and notarized. Foreign Nationals are required to have $10,000 per person, and an additional $2,000 for each accompanying dependent. For example, if a Foreign National s dependents include a spouse and two children, the settlement income required would be $16,000. The Government of the Northwest Territories is currently examining alternative methodologies for determining whether a foreign national has sufficient funds or income to settle and maintain themselves and any dependents in the Northwest Territories and will consult with the Government of Canada on these alternatives. If another method to determine sufficient funds or income is selected, the Government of the Northwest Territories will notify territorial employers and will update these guidelines. 8.3 Critical Impact Worker Stream Criteria This stream is intended to assist Employers with critical labour shortages that cannot be filled by local, permanent residents, or Canadian citizens.. This category is designed to increase the labour pool for entry level jobs described within the National Occupational Classification skill levels C and D. Foreign Nationals must have worked in the same position, obtaining the necessary work experience of at least six (6) months, and be in compliance with their temporary foreign worker permit. Language Requirements for Critical Impact A Foreign National applying under occupations classified as skill level C and D, under the National Occupation Classification, must undergo mandatory language testing and achieve a minimum standard of the Canadian Language Benchmark Level 4, in either the French or English language, across all four categories: listening, speaking, reading, and writing. This mandatory requirement ensures that the Foreign National is already able to communicate in one of the official languages of Canada; French or English. The language requirement must be met at the time of nomination. 16 NTNP-02a Critical Impact Worker Checklist Form NTNP-5 Authorize or Cancel an Immigration Representative Form (if applicable) Forms can be obtained from the website. 8.4 Skilled Worker Stream Criteria This stream is designed to attract qualified individuals that will assist with shortages of skilled workers in the Northwest Territories. This stream is for skilled occupations for which formal education and/or specialized training is required. These occupations are within the National Occupational Classification, Skill Levels 0, A, and B. Foreign Nationals under the Skilled Worker Stream must have the required work experience as outlined by the Employer in the job description and/or job advertisement. Language Requirements for Skilled Workers A Foreign National applying under occupations classified as skill level O, A, and B, under the National Occupation Classification must be able to communicate in one of the official languages of Canada; French or English. The language ability must be met at the time of nomination. This stream is for skilled occupations for which formal education and/or specialized training is required. These occupations are within the National Occupational Classification, Skill Levels 0, A, and B. The Northwest Territories Express Entry stream is only for Foreign Nationals who have been accepted into the Citizenship and Immigration Canada s Express Entry Pool. Once a candidate is accepted into the Express Entry Pool, Citizenship and Immigration Canada will issue: an Express Entry Profile Number; and Employer Driven Nominee Program Application Form Guidelines Page 15 of 23

17 Job Seeker Validation Code. Only candidates accepted into Citizenship and Immigration Canada s Express Entry Pool, and have been issued an Express Entry Profile Number, and a Job Seeker Validation Code, are eligible for this stream. For detailed information for Citizenship and Immigration Canada s Express Entry System please visit: Once a candidate has been accepted in to Citizenship and Immigration Canada s Express Entry Pool and has received the Express Entry Profile Number and the Job Seeker Validation Code they can apply to the Northwest Territories Express Entry stream. When applying for the Northwest Territories Express Entry System for Skilled Workers a candidate must: Provide the Express Entry Profile Number and Job Seeker Validation Code issued by Citizenship and Immigration Canada s Express Entry Pool; Meet the eligibility criteria for the Northwest Territories Nominee Program s Skilled Worker Stream (see section 8.4 of these Application Form Guidelines for eligibility to the Skilled Worker Stream); and have expressed interest in immigrating to the Northwest Territories. Once the above eligibility criteria have been met, the Employer can submit an application form to the Northwest Territories Express Entry System. 18 9.0 Nominee Application Forms This section of these guidelines provides an overview of each of the Employer Driven forms. Complete all sections. If a section does not apply to you, write Not Applicable or N/A. You must answer all questions on the application forms unless indicated otherwise. Original signatures are required by both the Employer and the Foreign National. If an application form is missing any of the documents listed in the checklist, it will be considered incomplete and processing of the application will be delayed. Note: When possible please complete forms online. Completed forms must be printed, signed, and original copies of all documents must be submitted with your application form. 9.1 NTNP-01 Nominee Information Form This form is used to collect the relevant information from the Foreign National being nominated. All information must be provided by the Foreign National (and/or an immigration representative). 9.2 NTNP-02 Employer and Job Information Form This form is used to collect the relevant information from the Employer nominating a Foreign National and must be completed by the Employer (and/or an immigration representative). Note: Completing the form electronically is easier and reduces the risk of errors that can delay the application form assessment process. Application forms need to be printed and signed and original copies of all documents must be submitted with your application form. 9.3 NTNP-05 Authorize or Cancel an Immigration Representative Form Use this form to name a representative (such as an immigration consultant, lawyer, friend, or family member) to act on your behalf with the Nominee Program. If you have named a representative, and want to cancel this representation, please use this form to cancel the representative you have named. Note: Hiring or using an immigration representative to apply to the Nominee Program is not a program requirement. 19 9.4 NTNP-02a Critical Impact Worker Checklist Form The Critical Impact Worker Application Checklist Form outlines the eligibility criteria for the program stream, and stipulates what information is required by both the Employer and the potential nominee. 9.5 NTNP-02b Skilled Worker Checklist Form The Skilled Worker Application Checklist Form outlines the eligibility criteria for the program stream, and stipulates what information is required by both the Employer and the potential nominee. Note: If an application form is missing any of the documents and/or information listed in the checklist, it will be considered incomplete and may delay the processing of the application form. 9.6 NTNP- 02c Northwest Territories Express Entry Checklist Form The NWT Express Entry Application Checklist Form outlines the eligibility criteria for the program stream, and stipulates what information is required by both the Employer and the potential nominee. 20 10.0 Supporting Documents 10.1 Language of Documents The Nominee Program will accept documents in both English and French. Documents not in English or French must be translated to either English or French and include an affidavit from the individual who completed the translation. The Employer will also need to include the original or certified copy of the document Certified True Copies To provide the Nominee Program with certified true copies an authorized person must compare the original document to the photocopy you expect to submit. The authorized person must include the following information on the certified true copy, the: phrase I certify that this is a true copy of the original document ; name of the original document; date of the certification; name of the person certifying the document; certifying person s official position or title; and certifying person s signature Who can Certify Documents You can get your documents certified in Canada or outside of Canada. The Nominee Program will only accept certified documentation in Canada from: a commissioner of oaths (authority to certify varies by province and territory), a notary public; or a justice of the peace. The Nominee Program will accept certified documentation from outside of Canada from: a judge; a magistrate; a notary public; an officer of a court of justice; or a commissioner authorized to administer oaths in the country in which the commissioner is living. 22 12.0 Definitions Assistant Deputy Minister A Northwest Territories official who has final decision making authority for the Northwest Territories under the Nominee Program. Business Driven Stream To assist Foreign Nationals with the ability to establish, purchase, or invest in an existing business that is selected primarily on the basis of its ability to create jobs for the Foreign National and other Canadians. Canada-Northwest Territories Agreement on Territorial Nominees The Agreement between the Northwest Territories and Canada that allows the Northwest Territories to nominate Foreign Nationals identified by Employers for permanent residency to Canada in the Northwest Territories. Citizen and Immigration Canada A Government of Canada s Department that is authorized to sign agreements with provincial/territorial governments to facilitate the coordination and implementation of immigration and refugee protection policies and programs such as the Nominee Program. Final authority rests solely with the Government of Canada in issuing immigration visas, permanent residency, and granting Canadian Citizenship. Critical Impact Worker Stream Designed to increase the labour pool for entry level employment in the hospitality and service sector industries. Department of Education, Culture and Employment A Government of the Northwest Territories Department that delivers the Employer Driven streams of the Nominee Program. Department of Industry, Tourism and Investment A Government of the Northwest Territories Department that delivers the Business- Driven streams of the Nominee Program. Employer Driven Stream This stream supports Employers to recruit and retain Foreign Nationals who possess the skills and experience required by the Employer and who meet program eligibility criteria, when there are no qualified Canadians or permanent residents available. Employment Standards The Employment Standards Act applies to most employees and Employers and sets out minimum employment standards in the Northwest Territories. Foreign National A person who is not a permanent resident or Canadian citizen, and is a citizen of another country. Immigration Classes Are immigration categories determined by Citizenship and Immigration Canada and are: Family Class, Economic Class, Skilled Worker Class, Business Class, and Provincial Nominee Class. For more information on each class, please see Citizenship and Immigration Canada s website at: Immigration Representative An individual who an Employer and/or nominee appointed to conduct business on their behalf with the Nominee Program. Representatives can be paid or unpaid. Labour Market Impact Assessment A verification process whereby Employment and Social Development Canada assesses an offer of employment to ensure that the employment of a Foreign National will not have a negative impact on the Canadian labour market. (The Labour Market Impact Assessment replaced the Labour Market Opinion June 20, 2014). Memorandum of Understanding An agreement signed between an Employer, a Nominee, and the Government of the Northwest Territories that details the roles and responsibilities for each party under the Nominee Program. National Occupational Classification A nationally accepted reference and description of occupations in Canada. It is used to compile, analyze and communicate information about occupations, and to understand the employment positions found throughout Canada's labour market. 24 Nominee A Foreign National who has been approved and nominated under the Nominee Program. Nominee Program An immigration program that allows the Northwest Territories to nominate Foreign National s to Citizenship and Immigration Canada for permanent residency in Canada. Permanent Residency A permanent resident is someone who has been given permanent resident status by immigrating to Canada, but is not a Canadian citizen. Permanent residents are citizens of other countries. Please visit: for more information. Refugee Claimant A refugee claimant is a person who has not yet received legal status from the Government of Canada. They are in the process of making a refugee claim and are working through the refugee determination process. Refugee claimants are not eligible for the Nominee Program. Settlement Income An amount that is required by a Foreign National, and his or her spouse, to support and maintain themselves and all dependents in the Northwest Territories. Spouse Includes common-law, partner, or spouse by marriage. Stream One of the individual programs under the Nominee Program. Temporary Foreign Worker Permit A permit provided by Citizenship and Immigration Canada that allows Foreign Nationals to work for a specified time period in Canada. Workers Safety and Compensation Commission An agency of the Government of the Northwest Territories that administers the Workers' Compensation Act, the Safety Act, the Mine Health and Safety Act, and the Explosives Use Act and the Acts Regulations to protect workers in the Northwest Territories. Employers must be in registered with the Workers Safety and Compensation Commission.
