4 Who is who? Michel Barnier European Commission Composed of a college of 28 Commissioners appointed by national governments. It represents the interests of the EU as a whole. What role? The European Commission will lead Brexit negotiations on behalf of the EU. Who? The European Commission s Brexit task force is led by Michel Barnier. Donald Tusk European Council Includes the heads of states or governments of the 28 Member States. In general, it sets the EU s political agenda but does not adopt laws. What role? The European Council adopted the negotiation guidelines (high political objectives) framing the European Commission s negotiation mandate. They will monitor closely the process and may adopt other negotiation guidelines in the future. Who? Donald Tusk is President of the European Council. Guy Verhofstadt European Parliament Consists of 751 members elected by European citizens. It represents the interests of European citizens. What role? The European Parliament adopted a resolution which fed into the European Council s negotiation guidelines and the European Commission s draft negotiation mandate. The European Parliament will be kept informed throughout the process as it will have to approve the fi nal result by a simple majority. Who? Guy Verhofstadt is the Brexit lead negotiator of the European Parliament. Didier Seeuws Council of the EU or Council Represents the governments of the 27 Member States (Ministerial level). What role? The Council approved the European Commission s draft negotiation mandate and will closely oversee the negotiations. It will also have to approve the draft agreement with a qualifi ed majority (72% of the 27 Member States representing 65% of the total population of the 27 Member States). Who? 5 Who is who? Theresa May Number Downing Street is the offi cial residence and offi ce of the British Prime Minister, and headquarters of the UK Government. What role? To lead negotiations on behalf of the UK. Who? Theresa May, Prime Minister. Amber Rudd Home Office Department in charge of managing immigration in the UK. What role? Tasked with designing the UK s immigration system after Brexit. Who? Amber Rudd, Home Secretary. David Davis Department for Exiting the European Union A new government department established in direct response to the UK s referendum on EU membership. What role? Responsible for overseeing negotiations to leave the EU and establishing the future relationship between the UK and EU. Who? David Davis, Secretary of State for Exiting the European Union. Boris Johnson Foreign and Commonwealth Office General responsibility for promoting the UK s interests around the world. What role? To support the Department for Exiting the European Union and to promote British interests in Europe. Who? Boris Johnson, Foreign Secretary. 5 Fragomen - Brexit timeline and key players - June

6 Rights of EU/UK nationals in the UK/EU UK White Paper While we are a member of the EU, the rights of EU nationals living in the UK and UK nationals living in the EU remain unchanged. As provided for in both the EU Free Movement Directive (Article 16 of 2004/38/EC) and in UK law, those who have lived continuously and lawfully in a country for at least five years automatically have a permanent right to reside. Securing the status of, and providing certainty to, EU nationals already in the UK and to UK nationals in the EU is one of this Government s early priorities for the forthcoming negotiations. To this end, we have engaged a range of stakeholders, including expatriate groups, to ensure we understand the priorities of UK nationals living in EU countries. EU negotiation mandate The Agreement should safeguard the status and rights derived from Union law at the withdrawal date, including those the enjoyment of which will intervene at a later date (e.g. rights related to old age pensions) as well as rights which are in the process of being obtained, including the possibility to acquire them under current conditions after the withdrawal date (e.g. the right of permanent residence after a continuous period of five years of legal residence which started before the withdrawal date). This should cover both EU27 citizens residing (or having resided) and/ or working (or having worked) in the United Kingdom and United Kingdom citizens residing (or having resided) and/or working (or having worked) in one of the Member States of the EU27. Guarantees to that effect in the Agreement should be reciprocal and should be based on the principle of equal treatment amongst EU27 citizens and equal treatment of EU27 citizens as compared to United Kingdom citizens, as set out in the relevant Union acquis. Those rights should be protected as directly enforceable vested rights for the life time of those concerned. Citizens should be able to exercise their rights through smooth and simple administrative procedures. The Agreement should cover at least the following elements: Definition of the persons to be covered Definition of the rights to be protected: residence, access to labour market, self-employment, social security, free movement rights Recognition of diplomas, professional qualifications UK and Ireland (Belfast agreement) UK White Paper We want to protect the ability to move freely between the UK and Ireland, north-south and east-west, recognising the special importance of this to people in their daily lives. We will work with the Irish Government and the Northern Ireland Executive to find a practical solution that recognises the unique economic, social and political context of the land border between Northern Ireland and Ireland. An explicit objective of the UK Government s work on EU exit is to ensure that full account is taken for the particular circumstances of Northern Ireland. We will seek to safeguard business interests in the exit negotiations. We will maintain close operational collaboration between UK and Irish law enforcement and security agencies and their judicial counterparts. EU negotiation mandate In line with the European Council guidelines, the Union is committed to continuing to support peace, stability and reconciliation on the island of Ireland. Nothing in the Agreement should undermine the objectives and commitments set out in the Good Friday Agreement in all its parts and its related implementing agreements; the unique circumstances and challenges on the island of Ireland will require flexible and imaginative solutions. Negotiations should in particular aim to avoid the creation of a hard border on the island of Ireland, while respecting the integrity of the Union legal order. Full account should be taken of the fact that Irish citizens residing in Northern Ireland will continue to enjoy rights as EU citizens. 6 Fragomen - Brexit timeline and key players - June
