4 2. Legislative Compliance This document has been drafted to comply with the principles of the Human Rights Act. Proportionality has been identified as the key to Human Rights compliance, this means striking a fair balance between the rights of the individual and those of the rest of the community. There must be a reasonable relationship between the aim to be achieved and the means used. Equality and Diversity issues have also been considered to ensure compliance with the Equality Act 2010 and meet our legal obligation in relation to the equality duty. In addition, Data Protection, Freedom of Information and Health and Safety Issues have been considered. Adherence to this policy or procedure will therefore ensure compliance with all relevant legislation and internal policies. 3. Procedures Provision of Catering in Emergency Scenarios and Major Operations Arrangements for requesting catering for emergency scenarios are: - Where the circumstances of the incident are exceptional and fall outside of usual daily policing operations, for example, homicides, large scale public disorder incidents, sieges, natural and man-made disasters, such as flooding, air crashes, gas explosions, multiple vehicle RTA s. Any request for catering provision must be authorised by the Duty Superintendent, SIO or Firearms Silver Commander based on the merits of each situation. In considering the request the following criteria shall be applied: - Nature of incident, anticipated number of staff deployed, and length of duty. Location of incident does this necessitate prolonged deployment to a location where it is impracticable to obtain refreshments locally nearby. Is it feasible to rotate staff to allow for breaks, or will this rotation have an adverse impact on the policing operation. Time of year/weather conditions. Financial cost of call out. Independent caterers will be called in and mobilisation may take hours dependant upon the scale of the incident. FCR/Duty Standby Manager Assets Department will ensure appropriate authorisation has been obtained on receiving request for call out. They will then assume responsibility for 12 hourly reviews of catering provision, in conjunction with the Incident Commander and ensure the Command and Control Incident log is updated with any catering decisions. Funding for emergency catering/major operations provision to remain centralised under catering subsistence budget. 4
5 The provision of meals for staff deployed on incident rooms will cease. Whilst the circumstances under which catering will be provided on a force call out basis are limited, this does not remove the need for local supervisors to consider all staff welfare needs in the management of any incident or operation. There will also be occasions where there is a need to make local arrangements for catering and any claims for reasonable expenditure should be submitted in line with current regulations and with relevant line management authorisation. Provision of Beverages (Tea & Coffee) Tea and coffee will be provided to designated meeting rooms only, these are: - Headquarters Executive Conference Room New Conference Room Reception Room Small Meeting Room off Reception Wyatt s Way Conference Room B Divisional HQ Local arrangements only C Divisional HQ Level 5 Conference Room D Divisional HQ F22 Meeting Room F30 Meeting Room Provision of Buffets External contractors will provide buffets at Headquarters and Divisions via the authorised list of suppliers available on the Intranet. Food will only be provided for meetings that include external customers/visitors for hospitality reasons, at the discretion of the Head of Department. Staff attending internal meetings with no external visitors present are deemed able to take their meals in the usual way and therefore shall make provision for their own meals when attending such meetings. 5
6 Force Large Scale Additional Catering Services Major Incidents Conferences/Special Events Liaison with the Facilities Manager Force HQ Assets Department should be undertaken at the earliest opportunity to enable efficient and effective scoping, planning and resourcing. External non-contracted companies will be utilised and mobilisation time will vary dependant upon the scale of the incident. Custody Catering Services PACE and Human Rights requirements of persons in custody shall be maintained at all times as directed by the Police Authority and Home Office. Food served shall be wholesome and of appropriate nutritional value for all persons. Detainees shall be provided with ambient meals and appropriate beverages at the Custody Officers discretion. Criminal Justice Department shall be responsible for all food safety aspects of the catering up to the point of hand-over. Any meal prepared by Police Officers and Police Staff shall ensure the force meets its obligations for compliance food Safety Regulations and assured safe catering systems and custody feeding risk assessment. Home Office Detainees Shall receive catering services in accordance with Home Office Prison Service Guidelines. 4. Monitoring and Review The Head of Department, Finance is responsible for the monitoring of impact and review of the guidance. The document will be reviewed every 3 years. 5. Appeals Process If a member of staff has an issue with this guidance they should contact the Head of Department Finance. Members of the public should write to the Director of Finance at Constabulary Headquarters. 6
