3 Vision A justice system that exemplifies fairness, integrity and upholds law and order thus enabling a safer and more progressive Sint Maarten. 3
4 Mission To create the conditions necessary for maintaining safety, security and upholding law and order within the community of Sint Maarten. 4
5 Purpose Ministry of Justice The Ministry of Justice serves as one of the most fundamental divisions of Government, its constitution and its populace. It is our mandate to develop, adopt and revise the civil, criminal, administrative and commercial legislation and procedures regarding amongst other: Immigration matters including admission and expulsion Juvenile delinquency Maintenance of public order Crime control and prevention Detention care, prisons, other detention facilities Policing and border control The Public prosecutor s office 5
6 Ministry of Justice Directly responsible for the following executing entities: Immigration and Border Protection services Police Force of St. Maarten Customs Prison and House of Detention Financial Intelligence Unit National Detectives Semi-private/autonomous organizations that function within the Justice sector and report to the Minister: Court of Guardianship Judicial Facilities Foundation (Probation & Family Supervision) Youth Correctional Facility (Miss Lalie Center) Coast Guard Joint Court of Justice Public Prosecutor s Office 6
7 The Minister of Justice is further supported by the Cabinet of the Minister, the Secretary General, the Staff Bureau and the Judicial Affairs Department. The Judicial Affairs Department is responsible for a number of tasks including: formulating policy execution and review of policy as it pertains to the internal ministerial affairs inspection of the quality of law enforcement and judicial complaints preparation and implementation of laws governing the rights of citizens within society and legal procedures 7
8 Strategic objectives and the ministry In keeping with the following strategic objectives as outlined in the governing program: Nation Building and Good Governance Sound Financial Management Public Safety Socio-economic & environmental sustainability Enhanced Quality of Life the main focus of the Ministry of Justice within this governing period and in particular in 2017 and 2018 shall be securing and maintaining Public Safety in the broadest sense while other objectives are also covered. 8
9 The Ministry of Justice shall: Initiative Strengthen provisions and access to information for the Public by: Maintaining weekly press briefings Improving our (online) presence and accessibility and Theme Develop and provide the highest quality education system and training for the justice and law enforcement chain by finalizing the: Organizational structure of the Justice Academy Curriculum of the Justice Academy 9
10 Theme Aim to secure a balanced budget and responsible spending by: Initiatives Working towards implementation of income generating measures by: Adapting the LTU (Landsverordening Toelating en Uitzetting) Pursuing legislation to raise revenue on the holding of events and the placement of signage Seeking alternative ways within Justice to contribute to the budget 10
11 Theme Implement Ordinances and policies to address safety Initiatives Evaluate Penalties for criminal acts by: Pursuing an agreement with the Netherlands for dealing with severe criminals and/or crime Reviewing applicable legislation Review legislation and policy within the judicial and legal sector Including the adapting of the advocatenlandsverordening By pursuing implementation of the National ordinance administrative sanctions (Landsverordering bestuurlijke handhaving) 11
12 Implement Ordinances and policies to address safety (cont d) Initiative Address legislation and policy to strengthen safety and security by: Enacting legislation to ensure privacy protection while carrying out video surveillance Adapting, reviewing and further implementing legislation aimed at combating cyber crime 12
13 Theme Improve the efficiency, effectiveness and quality in the justice chain by working towards Initiatives Optimizing the operations of the Prison Strengthening the Police force, the Customs department and the Immigration & Border Control Department Building upon and improving the use of the K9-Unit within the justice chain Developing closer ties with St. Martin towards improving safety and security of all citizens with law enforcement officials on Dutch and French side. 13
14 Improve the efficiency, effectiveness and quality in the justice chain by working towards (cont d) Initiative Upgrade the organizational management of the Ministry of Justice by implementing: The feasible aspects of the Plans of Approach National Decrees on legal status arrangements (Besluit rechtspositie regelingen) for Prison, Police and National Detectives 14
15 Improve the efficiency, effectiveness and quality in the justice chain by working towards (cont d) Initiative Tackle illegal immigration and Human Smuggling and trafficking by: Improving the immigration enforcement process, tracking and compliance Reviewing and finalizing the adult entertainment legislation and policy Broadening Human Trafficking control and support mechanisms Further strengthening cooperation between Customs, Immigration & Border Control, Judicial Care Services, Education and Public Health departments 15
16 Theme The Ministry will work towards strengthening safety and security Projects By finalizing the implementation of the Camera Project throughout the island By Intensifying efforts with Community Police Officers to prevent crime amongst youth through crime prevention programs 16
17 The Ministry will work towards strengthening safety and security (cont d) Initiative Reduce Youth Crime by: By further establishing a central reporting center for child abuse as well as reporting codes and investigation approaches in collaboration with ECYS Encouraging community service activities for youth offenders who are convicted of committing minor crimes Establishing a Youth Community Service policy for first offenders Providing for rehabilitation programs and guidance for (youth) offenders project 17
18 Theme Enhance safety facilities and resources Initiative Upgrade and expand safety and security facilities within Justice Finalizing the upgrade and expansion of the Point Blanche prison and the House of Detention to meet Sint Maarten s needs and international standards 18
19 Theme Fortify and diversify the tourism sector Initiative Strengthen the maritime and aviation hub position of Sint Maarten by Working towards formalizing the pre-clearance agreements with the USA 19
20 Theme Invest in human capital Initiative Support employment opportunities by Building upon existing reintegration programs and opportunities for detainees 20
