Overall Objective and Project Purpose 2.1 Overall Objective: Establish a greater security at Croatia s international borders according to Schengen standards in the area of border management and improvement of efficiency of Croatian Border Police. 1

2 2.2 Project purpose: Extend the National Border Management Information System on the 25 border crossing points into an integrated mechanism based on the design and tests made in Phase 1 and Link with AP/NPIEU The project is in line with the Accession Partnership (AP) priorities concerning border management. Sectors 3.1 and 3.2 of the AP specifically refer to the need to strengthen border management, implement the border management strategy; increase investments in technical equipment and infrastructure; and strengthen specialised training for border officers. Corresponding priorities are set in the chapters , and of the National Programme for the Integration of Croatia into the European Union 2006 (NPIEU) on border management. 2.4 Link with MIPD The project is in line with MIPD under component I. Transition Assistance and Institution Building, Ability to assume the obligations of membership, where is stipulated: the focus of assistance in this area will be on institutional capacity building for acquis transposition and implementation according to the priorities identified in the Accession Partnership 2.5 Link with National Development Plan Not applicable. 2.6 Link with national/ sectoral investment plans Strategy for the Development of IT and Telecommunications system of the Ministry of the Interior of the Republic of Croatia for the period between Description of project 3.1 Background and justification: Croatian border police, as the authority empowered to safeguard border security, faces a number of problems in its efforts to improve the current situation. Mostly, the problems refer to poor equipment in border control and surveillance, lack of adequately trained human resources, organisational deficiencies and outdated and inefficient legislation. At present, each border crossing in Croatia has an IT link with the central database of the Ministry of the Interior of the Republic of Croatia (MIRC). However, the system is outdated and requires a thorough upgrading. For example, the existing IT system does not allow recording and exchanging data automatically. Most of the necessary data is still collected and recorded manually. There are no IT connections to other countries' or international networks due to the lack of modern equipment and devices for faster and more detailed control Thus, the main objective in the field of border management is to bring the system at a high level standard, in line with other European countries. To reach such a desirable stage, a step-by-step approach is required covering the wide range of areas described above. That goal is stated in part of IBM Strategy that refers to IT structure: 2

3 An analysis of the current condition of the IT structure of the border police shows that the standard of equipment, especially on the level of the border crossings, is low and as such does not meet the requirements for information exchange. Software and hardware solutions are satisfactory at the moment. However, they do not fulfil the needs of a modern European border police force which needs to fulfil the Schengen standard. Taking into account the availability of financial resources, procurement of adequate IT equipment necessary for the efficient execution of border control (primarily referring to IT equipment on BCPs) needs to be considered. Procurement of adequate IT equipment will enhance the security of information exchange, cryptological data safety and protection, protection against viruses, etc., as well as introduce a new digital system of radio communication, while taking into account the availability of financial resources. Furthermore, it is necessary to adjust the information system of the Ministry of Interior to enable data exchange with the valid information system on EU borders at the time when project starts, taking into account cryptological security and data protection, virus protection and similar issues. Access to the Internet and Intranet are to be provided at all the levels within the Ministry of Interior where employees deal with tasks of controlling the national border in order to make available required operative data and information on the new regulations they will have to execute. It is necessary to replace all terminals in use by the border police with PCs connected to a local area network (LAN), which again should be connected to a private broadband business network (WAN) where not already the case. Equally, access to the information system of the Ministry of Interior should be provided on all border crossings, including the border crossings for small border traffic. On implementing the above, the conclusions of the CARDS 2001 Twinning Project Integrated Border Management - Border Police and CARDS 2002 NBMIS phase I, along with ongoing CARDS 2003 project NBMIS phase II which foresee IT equipment for the BCPs and adjustment of the information system of the Ministry of Interior to the valid information system on EU borders at the time when project starts, need to be taken into account in order to ensure synergy and to avoid any overlap. Also, it is pointed in the Development Strategy of the Border Police of Republic of Croatia as one of the priorities: Analysis of the found situation of IT structure of the Croatian border police has shown that the degree of equipping especially at the level of border crossings is very low. Software and hardware solutions momentarily are still satisfactory but they don t fulfil requests that are in front of one modern European border police and which especially need to fulfil Schengen standards. Documents provided through the Twinning project CARDS Integrated border management-border police show concrete steps for the re-establishment necessary technical standards in the Croatian border police, and show concrete steps and bases useful to all organisational units of the Croatian border police. One of the step needed to reach the overall objective is to develop an efficient border control mechanism following the demands modern crime forces upon. Today, a core tool in border management is to have access to a strong and accurate information system equipped with new technical devices such as optical readers of documents, forged document identification system, vehicle counter etc. A modernised system provides all kinds of relevant information to border police officers guiding them through further procedures. Under the CARDS 2002 NBMIS - phase I project, two main groups of activities are being carried out: "Institution building" support to the MoI relating to architecture and testing of border management information systems and corresponding institutional and administrative structures; 3 TETRA Private business radio network 4 VISIONS/VIS Visa system. They should ensure that they have the latest version of the Visa Regulation (should be adopted in June 2007). 5 IKOS-Information-communication system of the Ministry of foreign affairs of the RC through which DKP of the RC send to the Visa Section of the MoI. 6 S.I.R.E.N.A. 5 "Investment' support related to a) the development and pilot testing of the information system, and b) strengthening control and surveillance capacities. The main criteria for selecting border crossings that were included into the CARDS projects were the following: a) category of the border crossings, b) number of passengers and vehicles passing through border crossings, c) the existence of permanent solid infrastructure solutions at the border crossings, which guarantees that the equipment to be installed will not be removed due to further expansion/reconstruction of border crossings. Hence, in the framework of the CARDS 2002 project (PHASE I), the border crossing point Bajakovo, as one of the largest international road border crossing points, and Airport Pleso, as the largest international air border crossing in the Republic of Croatia were selected for this project. These border crossings are also the largest border crossings in their category (border crossing Bajakovo shall have 25 border controls for passengers and vehicles, while Airport Pleso shall have 12 border controls for passengers). The budget of this project is 1,7 M, and the main activities include: equipping the above mentioned border crossings, developing an application for border police and the corresponding main application server, and equipping a classroom of 20 working places at the Police Academy for the training of border police officers who will be working with the new NBMIS system. Achieved results of phase I fully justify investing and equipping of the border crossings through the NBMIS projects. Results of phase I show that in period of 2 months of testing there is an increase of 300% of persons found in files for wanted persons, as compared to the same period the year before. For the Phase II, international road border crossings with and Montenegro with the largest number of passengers and vehicles have been selected. The project contains exclusively an investment component (1,7 M ), and the planned activities envisage investment for the following 6 road border crossings: Gunja, Županja, Slavonski Brod, Stara Gradiška, Slavonski Šamac and Karasovići, and one air border crossing Airport Split. For the Phase III, with regard to the priorities related to the future equipping of border crossings, and the fact that one day these Eastern borders shall become the external borders of the European Union, in case the Republic of Croatia enters the European Union before Serbia, Montenegro and. Ministry of Interior proposes to continue the NBMIS Project through the NBMIS Phase III follow-up project with the aim of properly equipping all the important border crossings (road, maritime, railway and air), classified as and II, with the Serbia, Montenegro and, which were not included in the previous CARDS projects. (Table 1: Overview of BCP proposed for equipping within the Project NBMIS - Phase III). Phase III contract shall be a turn-key contract. With the aim of further strengthening the security at Croatia s international borders, we need to point it out that the MoI has signed contract for amount of 28 million which will be invested until end of 2008 in fully developing the TETRA system and established AFIS system. 5

6 3.2 Assessment of project impact, catalytic effect, sustainability and cross border impact Catalytic effect: The realisation of the project will have a positive effect by speeding up Croatia s harmonisation with the EU. Sustainability: During the implementation of the Project, the main beneficiary units within the Ministry of the Interior will be provided with many recommendations for administrative and logistical changes. The Ministry shall then provide for its effective implementation, which will guarantee the sustainability of efforts. The Ministry of the Interior is also committed to provide funds for the maintenance of the procured equipment. The equipment procured through this project and its utilisation shall not have adverse effects on the environment. Additionality is ensured. EU funding will not replace other funding from the government or other donors and the EU funded intervention/project will result in benefits which would not occur otherwise. 3.3 Results and measurable indicators: 1. A pre-selected number of border crossing points fully operational following the installation of adequate equipment. Indicator: Integrated information system operational at 25 border crossing points. 2. Border staff attached to the selected border crossing points professionally trained and familiar with the operation and maintenance of the newly acquired equipment. Indicator: Staff trained in operation and management of the system (450 police officers for border control and 120 shift leaders on border crossing points). 3. Project implemented in line with Quality Assurance Plan and other project documents. Indicator: Project implemented in time and in line with signed supply contract. 3.4 Activities: 1.1 Make a pre-selection of those border crossing points that are going to benefit from the IPA 2007 program assistance. 1.2 Based on the detailed technical specifications purchase the requested equipment that have not different technical characteristics which would result in either incompatibility or disproportional technical difficulties in integration and operation with NBMIS web application and equipment from phase 1 and 2 of this project. 1.3 Make sure that the acquired equipment will be installed and tested adequately. 1.4 Upgrade and extend functionality of NBMIS web application from phase 1 and 2 to this project. Beneficiary will provide source code and documentations of NBMIS web application. 1.5 Connect those border crossing points equipped with modern devices with the NBMIS server in the Ministry. 1.6 Improve NBMIS application server performance. 1.7 Monitor and guide the process until its fully implementation. 6

7 2.1 Train and familiarise staff attached to the selected border crossing points in the operation, monitoring and management of the specific devises. 2.2 Operate as helpdesk for border police staffs that are facing difficulties with operation of the system 3. Preparation of Quality Assurance Plan for the implementation of project 3.5 Conditionality and sequencing: Project of this size require full commitment and involvement on behalf of senior level officials of the beneficiary institution. Therefore, the leadership of the Ministry commits itself to provide adequate staff and support as well as to introduce the institutional changes identified as needed for the successful implementation of the project. Other conditions that had to be fulfilled: 1. NBMIS 2 must have been successfully completed, and approved by twinner. 2. Recommendations for corrections in TD from CARDS 2003 twinner and FWC must be taken into account before tender is launched. 3. 'Users Needs' for coastal BCP has to be ready, through responsibility of MOI, before TD can be published. Sequencing: The supply component can be tendered immediately. 3.6 Linked activities Both the Government of Croatia and the European Commission have acknowledged the importance of developing a professional border management system in Croatia. Assistance programmes under CARDS 2001 and 2002 have been defined to tackle the problem. Developing a professional border management system is a lengthy process that can only be covered through multi-annual assistance. To reach the best possible results, it is essential that contractors active under the present programme will closely co-ordinate and fine-tune their activities with the professional teams active under CARDS 2001 and 2002 respectively. The CARDS 2001 Programme assistance for the Croatian Border Police was mainly focused on a twinning arrangement with the German Border Police as leading partner institution. Slovenian Border Police joins as junior partner within the project. The twinning project was basically focused on strengthening the institutional and administrative capacity of the Croatian Border Police. Furthermore, CARDS 2001 "Integrated Border Management Interagency Cooperation", another project aims on further developing inter-agency co-operation, between Border Police, Customs and other services active at border crossing points, was successfully completed in the December Under the CARDS 2002 Programme, a start is made with the development of a National Border Management Information System (NBMIS), which is considered to be a core tool to continuously assess the situation at the countries borders, to safeguard the internal security and to combat illegal immigration. CARDS 2002 assistance is designed as a tailor-made border management information system in line with the IT strategy developed by the Government informatics office and compatible to currently existing 7

8 systems within the MoI. The new system design is first of all build upon the existing MoI IT-Systems and improved and upgraded them in their functionality, and at the same time take as much as possible into account the processing of data according to the standards of specific EU-Information Systems, as for example SIS II, EURODAC, FADO. Under the CARDS 2003 Programme NBMIS will be established on 6 road BCPs and 1 international airport. The CARDS 2003 Programme contains another TW project for the Croatian Border Police, Continued Support and Capacity Building for the Border Police Directorate", which has successfully completed in the October Also, Twinning light project ACBF 2004 Assistance and monitoring of CARDS 2003 NBMIS phase II started in February Lessons learned The first Twinning Project for the Croatian Border Police was implemented in 2002 and 2003 as part of the CARDS 2001 "Integrated Border Management" Project. Through this Project, a detailed status assessment of the Croatian Border Police was conducted and necessary prerequisites for the continuation and further development of the Croatian Border Police were produced, with regard to legislation, general organisation and human resources, technical equipment and IT structure, as well as training and education of the border police. The documents established under the mentioned Twinning Project formed the first strategic basis, not only for the further development of the border police, but also for the nomination and implementation of future projects financed by the EU. A number of discussions were organised with both the Stabilisation and Association Process Advisor and IT specialist operating under CARDS 2001 Twinning project to have their opinion about the feasibility and systematic planning of the phase-wise approach especially in relation to the installation of the integrated information system. Along with the Strategy for the Development of the Border Police, a National Strategy for Integrated Border Management was produced in the framework of the CARDS 2001 Project "Integrated Border Management Interagency Cooperation". This strategy envisages better coordination of the work of all agencies with a competence at the state border. Along with the strategy, an Action Plan for its implementation was elaborated and is already under execution. The Border Police Development Strategy and the National Strategy for Integrated Border Management are harmonised with each other and were both adopted by the Government of the Republic of Croatia in April The first Twinning Project for the Border Police under CARDS 2001 was followed by a second one under the CARDS 2003 Programme, with the title "Continued Support and Capacity Building for the Border Police Directorate". The project started in July 2004 and was concluded in October Both of these projects were aimed to strength the border police on its way towards reaching European standards. Further, the findings and recommendations of the second Peer-Based Assessment Mission of independent experts in the field of Justice, Freedom and Security, which 8

9 was carried out by the European Commission in May 2005, are in the line with the purpose of this project. 4. 17 ANNEX IV JUSTIFICATION FOR TA Due to a fact that project s duration is envisaged for 36 months and just two activities envisaged to be completed beside investment component, MoI is on the position that twinning in duration of 36 months would be to expensive. Especially, because these two activities will be spread on the beginning and on the end of project. First activity is predicted to help MoI project implementation team to insure quality implementation of project. MoI will be responsible for project management and because of that in NBMIS phase II project management team will be trained for project management through TA component. Second activity in phase III will be at the end of project. Consultant from TA will be responsible to prepare Provisional Acceptance in cooperation with MoI team. 19 EXPLANATORY COMMENTS REGARDING NOMINATION AND STATUS OF BCPS ENVISAGED FOR EQUIPPING THROUGH EU PREASSISTANCE PROJECTS In the framework of the IPA 2007 Preaccession Program, the III phase of the National Border Management Information System has been nominated for the purpose of reaching a heightened security at Croatian borders and accomplishing the continuation of building up and broadening of the National Border Management Information System on the basis of the I and II phases setting up the System. This Project aims at further building of the National Information System of the Ministry of the Interior and at the more effective border control and readiness to respond to the ever more demanding fight against crossborder crime. In line with the priorities set for the continuation of equipping border check points for the purpose of more effective border control, particularly at the future EU external borders (towards Serbia,, Monte Negro), through the IPA 2007 Project, the III phase of the National State Border Management Information System has been nominated. This Project is dedicated for the equipping of 25 new border check points that will remain at the external EU border upon the entry of the Republic of Croatia to the EU and the Schengen area. It should be noted that through the border check points covered by all the three phases, over 75 % of overall traffic of vehicles and passengers is being carried out at the future EU external borders with Serbia,, Monte Negro and through maritime and airport check points. Speaking about cutting down the number of border check points and their recategorization, it should be pointed out that the check points listed for equipment in the III phase will not be abolished, but that those with lesser traffic and the ones intended for local border traffic will be the matter to consider. After the Working Group establishes the precise number of check points, an additional analyses will be done to show which check points should be interpolated into NBMIS and at what pace. CONCLUSION: It should be pointed out that the equipping of these 25 check points (besides the 9 ones of Phase I & II) encompasses all the major international most frequented check points. The minor check points at the EU external border are not going to be equipped in the framework of the mentioned three phases.
