4 Background Senate Bill th Legislature (2001) The Dallas Police Department collaborated with Senator Royce West during the early development of this legislation. The Dallas Police Department advocates equipping all police patrol vehicles with video cameras and continues to work toward that goal. 4

9 Dallas Police Department Response The Dallas Police Department has taken the following steps to ensure compliance with Senate Bill 1074: 9
10 Philosophy Statement It is the goal of the Dallas Police Department to provide public safety service that is both effective and fair. To achieve this goal, racial profiling is strictly forbidden and will never be tolerated in the Dallas Police Department. The reality and the perception by all citizens must be that police officers do not stop, detain, or take enforcement action based solely upon race, color, or ethnicity. Racial profiling incurs the cost of eroding the trust between police and citizens, thus undermining the legitimacy of police actions. Through determination, vigilance, and training, the Police Department will foster and maintain the confidence of all citizens in the integrity and professionalism of its police officers. All citizens must believe that the administration of justice is applied fairly and that racial profiling is never used as a means of enforcement. They must also believe that they will be judged solely on their own conduct and never on racial generalizations. The Dallas Police Department is committed to protecting the rights of all citizens. 17 Tier I Data Collection Methods of data collection: Citations have check-boxes required for racial profiling data collection. Scantron forms are used for additional data collection. Race/Ethnicity contact data is compiled from traffic citation and arrest computer databases Complaints alleging racial profiling are tracked by the Internal Affairs Unit. 17
18 Tier I Data Comparisons This report contains information on police traffic related contacts with the public between January 1, 2004 and December 31, The raw data alone is not sufficient to draw conclusions regarding racial profiling trends. There is no generally accepted method of determining a baseline with which to compare the police contact raw data. Therefore, we have presented the data along with various comparison baselines. 18
19 Tier I Data Comparisons Dallas Population Baseline Census population data includes all residents of the community sorted by Race/Ethnicity. Census data includes all ages regardless of whether they are, or are not, among the driving population. Dallas population baseline does not provide data for comparing contacts with nonresidents. 19

All custody arrests were assumed to have non-consensual searches and were so listed. Non-consensual searches include: frisks, search incident to arrest, probable cause searches and vehicle inventories. 28

31 Complaints on Racial Profiling The Dallas Police Department responded to 595,595 calls for service and made 226,039 documented traffic contacts. Out of those 821,634 contacts, only 13 (.0016%) resulted in complaints being filed with the Internal Affairs Unit alleging racial or other profiling. Eight of these complaints resulted from discretionary traffic stops. 31

33 Review of Data The Dallas Police Department requested Dr. Eric Fritsch and Dr. Robert Taylor, Department of Criminal Justice, University of North Texas, to review this report. Their analysis of DPD report - Department is in compliance with applicable Texas law on the collection of racial profiling data. 33

35 Tier I Data Collection Compliance A review of Dallas Police Department data has revealed a potential discrepancy in traffic contact ethnicity categories: Because DPS Texas Driver Licenses do not contain Race information, officers have to use their best judgement as to a person s race/ethnicity. This has potentially resulted in incorrect data collection for the numbers of White and Hispanic traffic contacts. It may also affect other ethnic numbers. 35
36 Tier I Data Collection Compliance (cont.) A Dallas Police Department internal audit (2003) revealed the following regarding Tier I data collection: The Department s compliance with racial profiling data collection procedure for arrests was met for 89% of qualifying arrests. The Department s compliance rate with racial profiling data collection procedures for traffic citations were met 90% of the time. The Department s compliance rate for submitting proper Scantron information is 95% 36

38 Recommendations for 2005 The Dallas Police Department will adopt the following measures to continue addressing racial profiling issues: Continue to provide Cultural Diversity and Racial Sensitivity training to all sworn members of the Dallas Police Department. Re-emphasize guidelines of behavior demanded by the Dallas Police Department. Continue supervisory training in evaluating subordinates contacts. 38
39 Recommendations for 2005 (cont.) DPD measures to (continued): Keep city officials informed of measures being implemented by the Department. Host public sessions to share information on department measures being adopted. Include racial profiling data collection as part of the new electronic citation program. Include racial profiling data collection as part of the electronic arrest reporting system. Conduct regular compliance audits. 39
40 The Dallas Police Department will continuously monitor compliance with data collection and reporting requirements set forth in Senate Bill Every effort will be made to comply with the spirit as well as the letter of the law. 40
