The SFDCCC s endorsement vote will occur at the meeting of the SF Democratic Party at the State Building, Milton Marks Auditorium, 455 Golden Gate Avenue, on Wednesday, March 16 at 7pm. Only candidates who return a completed questionnaire electronically by the due date will be allowed to present before the committee. At the time of the interview, you may also provide 15 copies of up to 4 pages of information for distribution to SFDCCC members. While it may seem that some of these questions do not apply to the office you are seeking, they represent Democratic Party principles and since you may run for higher office where these questions will be relevant, we would like them addressed. We will distribute the questionnaires to the DCCC members and post them on the S.F. Democratic Party s website (at for the public to view. 1

Yes: No: x If Yes, who? When? 5. Please provide a brief summary of your qualifications for this office. (No more than 200 words.) In almost three decades of work as a lawyer, I have handled hundreds of cases in the Bay Area s courts. I have received the highest rating of AV Preeminent from Martindale Hubbell s peer rating service, and have served as general counsel and president for San Francisco La Raza Lawyers Association. I have tried cases involving issues including breach of contract, intentional torts, punitive damages claims, and corporate governance. I have devoted a significant portion of my practice to representing pro bono or low income clients, in an effort to ensure access to justice for those who cannot afford legal representation. I received excellent legal training as a research attorney for the San Francisco Superior Court, as a law clerk for one of San Francisco s best plaintiff s attorneys, and with a major San Francisco law firm. After years of service as a volunteer mediator for the court, I was sworn in as a pro tem judge and have handled unlawful detainer, juvenile, traffic, and civil discovery cases in San Francisco. I am honored that judges I have appeared before, litigants, opposing counsel and clients, have supported my candidacy. For more information, please see 2

3 8. Please describe your contributions to the Democratic Party at the local, state and or/national level in the last 4 years. (No more than 200 words.) Through voting and through appearing to speak before the DCCC. I also campaigned for a local candidate in 2014 and phone banked to get out the vote for the 2014 elections. 9. If elected, what are the three top issues you will work to affect? (No more than 200 words.) (1) Abiding by the Code of Judicial Ethics and ensuring access to justice through the court system, by a fair and impartial judiciary, regardless of economic, social, cultural, and linguistic circumstances of litigants, and regardless of whether litigants are represented by counsel or in pro per (representing themselves). (2) Continuing efforts to improve access of the public to their judicial officers through community outreach. (3) Continuing efforts to support pursuit of life, liberty, and happiness, regardless of a person s background, economic, or other circumstance. 10. What have you done to mentor women and people of color in your field? (No more than 200 words.) This has been so much a part of my life for so many years it is hard to identify which examples to include here. I co-chaired the San Francisco La Raza Lawyers Association mentorship committee starting in 2010, and continued as the sole chair of that committee for some years after that; in 2013, I mentored the new chair of that committee, facilitating connections between members of the judiciary and established lawyers with student and new lawyer members of San Francisco La 3

4 Raza Lawyers and other minority bar associations. In 2014 I became co-chair of the Minority Bar Coalition in the San Francisco Bay Area. I have mentored students, women, and lawyers of color, bringing them to Inn of Court events, volunteering with Black Women Lawyers of Northern California for an evening at the detention facility at the juvenile court in San Francisco, and coaching students from Abraham Lincoln High School for the California Constitutional Rights Foundation mock trial competition. I regularly receive and respond to phone calls from new lawyers who are women and/or people of color asking for advice in case handling. In 2015, due in part to this work, I received a Distinguished Alumni award from U.C. Hastings La Raza Law Students Association. 11. Please note: for the support/oppose questions below I have left some blank due to the constraints imposed by the California Code of Judicial Ethics, but I have tried to address these as well in the explanation section below. If you need to add further explanation or qualification to any of your support-or-oppose answers above, you may do so here: This questionnaire touches on a variety of legal issues. As a judicial candidate, I am not allowed to take public positions in support of specific pieces of legislation or specific policies, as delineated in Canon 5(B)(1) of the California Code of Judicial Ethics, which provides, in part, that [a] candidate for judicial office... shall not: (a) make statements to the electorate or the appointing authority that commit the candidate... with respect to cases, controversies, or issues that are likely to come before the courts. Question 1. As a judge, I would uphold and apply currently applicable law. In 1973, the United States Supreme Court held in Roe v. Wade, in part, that For the stage prior to approximately the end of the first trimester, the abortion decision and its effectuation must be left to the medical judgment of the pregnant woman's attending physician. Since 1973, this case and its progeny have upheld a woman s right to choose. Question 2. As a judge, I would uphold and apply currently applicable law. In Regents of the University of California v. Bakke, 438 U.S. 265 (1978), the Court upheld affirmative action, but held that specific racial quotas were impermissible. Fisher v. University of Texas, concerning the affirmative action admissions policy by the University of Texas at Austin, remains pending before the United States Supreme Court. Questions 3 through 8. Again, as a judge, I would uphold and apply currently applicable law. The questions of what are essential government services, and to what extent those may be 5

6 privatized, and under what circumstances, is a question that has been the topic of considerable public discussion; examples of this include the debate regarding privatization of prisons, the use of private contractors in Iraq, and the ongoing discussions regarding the use of San Francisco s bus stops by private buses. I can t respond to this question given its breadth and given the constraints placed on candidates for judicial office. Sentencing guidelines have been the focus of renewed legislative activity in recent years; by way of one example, in 2014, Proposition 47 passed, reducing penalties for some drug and theft crimes; more recently, efforts to place the Public Safety and Rehabilitation Act of 2016 on the November 2016 ballot are underway. Rent control provisions have been upheld by the United States Supreme Court, and various aspects of rent control have been subject to challenge. As a judge, I would uphold and apply applicable law. Sustainable Communities Pledge On February 25, 2015, the San Francisco Democratic County Central Committee enacted a resolution in support of the San Francisco Building and Construction Trades Council's Sustainable Communities Pledge. The pledge advocates for good-paying construction jobs for local residents; increasing housing and specifically affordable housing; and requiring environmentally responsible building in partnership with organized labor. As part of that resolution, the San Francisco Democratic Party now includes the Sustainable Communities Pledge as part of its endorsement questionnaire. The complete text reads as follows: Whereas, past patterns of urban and suburban growth and development are not sustainable and state law now requires the adoption of sustainable communities strategies that will incentivize urban infill and transit-oriented development; and Whereas, this shift in land use and transportation policy is already resulting in an unprecedented level of private investment for residential, commercial, and retail urban infill development and construction, which is projected to increase over the next twenty years; and Whereas, the Bay Area should welcome more intensive, compact development along transit corridors to meet our obligation to reduce emissions of greenhouse gases; and Whereas, it is critical that private investment and construction in this development contribute to economically vibrant, healthy, and equitable communities, including providing housing for an 6

7 economically diverse work force and walkable neighborhoods well served by employment, shopping, and recreational opportunities; and Whereas, it is critical also that this private investment and construction provide tangible economic benefits including employment to residents, and not just profits to investors; and Whereas, communities benefit more fully from construction and development when construction employers offer job training and apprenticeship opportunities, hire local workers, and pay area standard wages; and Whereas the value of every dollar in construction wages spent by local workers is multiplied as it circulates through the local economy and local small businesses; and Whereas, local spending of construction wages generates much-needed sales tax revenue to local governments, I pledge to support and give priority to projects that abide by these principles of a sustainable, economically vibrant, and equitable community by: Furthering smart land use and growth policies by using energy efficient and environmentally sustainable building design and supporting alternatives to the automobile for transportation; Ensuring in cooperation with their representative organizations that local workers are hired on project construction and are paid area standard wages and benefits, including employer-funded healthcare for themselves and their families; Providing outreach to local youth and disadvantaged communities and opportunities for their training and employment through state-approved Labor/Management apprenticeship programs; Providing construction employment and training for our military veterans; Ensuring that affordable units are provided along with any market-rate residential units; and Providing such other community benefits and amenities as will offset a project s identifiable adverse impacts on the community.
